Welcome to Recap.Tube ("the service"). By accessing or using our website and services, you ("the user") agree to be bound by these Terms of Service. These terms govern your use of the Recap.Tube platform, including the creation of Recaps, image uploads, and search features.
Recap.Tube is a tool for curating and organising existing YouTube content. We do not host the video content ourselves; all video playback is powered by the YouTube Embedded Player. Consequently, by using Recap.Tube, you acknowledge and agree that you are also bound by the YouTube Terms of Service and the Google Privacy Policy.
If you do not agree to these terms, please do not use our services.
1. Eligibility and Account Registration
1.1 Age Requirements
By using Recap.Tube, you represent that you are at least 13 years of age (or the minimum age of digital consent in your country). If you are under the age of 18, you represent that you have the permission of a parent or legal guardian to use the service.
1.2 Authentication via Google
To access the core features of Recap.Tube, you must sign in exclusively through a valid Google Account. You are responsible for maintaining the security of your Google Account. Recap.Tube does not store your Google password; however, we do store essential tokens and profile information in our private database to facilitate your session and account profile.
1.3 Admin Approval Process
Registration does not grant immediate access to all features. To maintain the quality and safety of our community:
- All new accounts are subject to admin approval.
- We reserve the absolute right to approve, deny, or revoke access to any account at our sole discretion, without providing a specific reason.
- Your account will remain in a "pending" state until an administrator has reviewed and authorised your access.
1.4 Accuracy of Information
You agree to provide accurate and truthful information during the registration step. Any attempt to impersonate another individual or bypass our moderation filters during setup is grounds for immediate account rejection or termination.
2. YouTube Integration and Content
2.1 Incorporation of YouTube Terms
Recap.Tube utilises YouTube API Services to allow users to search for, curate, and play video content. By using our service, you acknowledge and agree that you are also bound by the YouTube Terms of Service. We recommend that you review these terms carefully, as they govern your rights and conduct regarding all video content accessed through our platform.
2.2 Google Privacy Policy
In addition to our own Privacy Policy, the use of YouTube API Services is governed by the Google Privacy Policy. This policy explains how Google treats your personal data and protects your privacy when you use their services via Recap.Tube.
2.3 Nature of Service
Recap.Tube is a curation and recapping tool. We do not host, store, or re-transmit YouTube video files. All video playback is delivered via the official YouTube Embedded Player. As such:
- Availability: We are not responsible if a video becomes unavailable, is deleted by the creator, or is geo-blocked by YouTube.
- Monetisation: We do not circumvent YouTube’s advertising or monetisation features. Users must respect the intellectual property rights of the original content creators.
- No Endorsement: Recap.Tube is an independent application and is not affiliated with, sponsored by, or endorsed by Google or YouTube.
2.4 Third-Party Revocation
You may revoke Recap.Tube’s access to your data at any time via the Google Security Settings page. Please note that revoking these permissions will result in the loss of functionality for your Recap.Tube account, but will not delete data from our database. You must reach out separately to request the deletion of our data.
3. User Conduct and Prohibited Content
3.1 Prohibited Content
You are solely responsible for the content you create and the images you upload to Recap.Tube. You agree not to create Recaps; upload avatars, thumbnails and overlay images; or use profile or Recap metadata (such as usernames, display names, pronouns, names and descriptions) that contains:
- Illegal Content: Any material that violates local, state, national, or international laws.
- Hate Speech & Harassment: Content that promotes violence, incites hatred, or harasses individuals or groups based on race, religion, gender, sexual orientation, disability, or any other protected characteristic.
- NSFW & Explicit Material: Pornographic, highly suggestive, or excessively violent content.
- Unauthorised IP: Images or content that you do not have the legal right to use, including copyrighted photos or trademarks.
3.2 Prohibited Behaviours
To maintain the integrity of Recap.Tube, the following behaviours are strictly forbidden:
- Spamming: Creating a high volume of low-quality Recaps for promotional purposes, or using metadata to redirect users to malicious or commercial websites.
- Abuse of Service: Attempting to bypass our two-layer moderation system, circumventing admin approval, or reverse-engineering our API and search logic.
- Harassment: Using our search or public profile features to target, "doxx," or track other users against their will.
- Automated Access: Using bots, scrapers, or other automated tools to access Recap.Tube without our express written consent.
3.3 Automated Moderation Disclosure
To ensure a safe environment, Recap.Tube utilises a multi-layered moderation system. By using the service, you acknowledge and agree that:
- Banned Words Filter: Your input (usernames, display names, and recap metadata) is automatically screened against a database-backed list of offensive and reserved terms.
- AI Processing: Content that passes the initial filter may be further processed by third-party artificial intelligence (OpenAI) to detect nuanced violations such as hate speech or harassment.
- Human Oversight: We reserve the right to manually review any content and remove it at our sole discretion, regardless of whether it was flagged by automated systems.
3.3.1 Data Privacy in Moderation
We aim to ensure that when user-generated content is processed by third parties for moderation purposes, it is handled securely. We do not provide highly sensitive identifiers — such as your email address — to these third-party providers. Furthermore, we take reasonable steps to ensure that any content submitted for moderation is processed via professional API interfaces that do not utilise your data to train or improve third-party AI models.
3.4 Consequences of Violations
If we determine that you have violated any part of this section, we may take immediate action, including but not limited to:
- Removing or hiding your Recaps from public search.
- Deleting uploaded images from our storage.
- Permanently banning your account.
4. Intellectual Property
4.1 Our Intellectual Property
All rights, title, and interest in and to Recap.Tube — including our software, source code, website design, search algorithms, logos — are and will remain the exclusive property of Recap.Tube. You may not copy, modify, or reverse-engineer any part of our platform without our express written permission.
4.2 Your Content and Media Uploads
When you create a Recap or upload overlay images and thumbnails to our service, you retain your ownership rights to that original content. However, by uploading or creating content on Recap.Tube, you grant us a worldwide, non-exclusive, royalty-free, and sub-licensable licence to:
- Host, store, and display your media in connection with the service.
- Facilitate the sharing and viewing of your Recaps and all associated metadata based on the privacy settings (Public, Unlisted, or Private) you have selected.
4.3 YouTube Content Rights
You acknowledge that the video content curated within your Recaps is the property of the original YouTube uploaders or their respective copyright holders. Recap.Tube does not claim any ownership over YouTube video content. You are responsible for ensuring that your use of such content within a Recap complies with "Fair Use" principles and does not infringe upon the intellectual property rights of third parties.
4.4 Copyright Infringement (DMCA)
We respect intellectual property rights and will respond to clear notices of alleged copyright infringement. If we receive a valid notice that an uploaded image or metadata violates a third party's copyright, we reserve the right to remove that content and terminate the associated account in accordance with our moderation and termination policies.
5. Account Termination and Deactivation
5.1 Discretionary Access
As Recap.Tube requires manual admin approval, access to the service is a privilege and not a right. We reserve the right to withdraw approval or restrict access to any account at any time, for any reason, and without prior notice or liability.
5.2 Deactivation
An account may be deactivated by an administrator. In this state:
- The account and its associated data (Recaps, badges, and profile information) continue to exist within our database.
- Access to the platform for that user is suspended.
- Publicly listed Recaps associated with a deactivated account may be hidden from search results at our discretion.
5.3 Termination and Banning
In cases of severe or repeated violations of these Terms, an account may be terminated or banned. Termination of an account results in the following:
- Permanent Removal: All user-generated content, including Recaps and images uploaded, will be deleted.
- Unrecoverable Data: This process is unrecoverable. Recap.Tube is not responsible for the loss of any data resulting from a ban.
- Prohibited Re-registration: Users who have been banned are strictly prohibited from creating new accounts using different credentials to bypass the restriction.
5.4 Voluntary Deletion
You may request the deletion of your account at any time by contacting us at [email protected]. Please note that while your personal profile and uploads will be removed, certain metadata may be retained in our or third-party backups or moderation logs for a limited period to comply with legal obligations or to prevent ban evasion.
6. Disclaimers and Limitation of Liability
6.1 "As Is" and "As Available" Service
Recap.Tube is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the service. While we strive to maintain high performance using the technologies available, we do not guarantee that the service will be uninterrupted, error-free, or free from harmful components.
6.2 Third-Party Dependency Disclaimer
You acknowledge that Recap.Tube relies on third-party providers, including but not limited to YouTube, Google Cloud, OpenAI, and Amazon Web Services. We are not liable for:
- Any changes to, or cessations of, the YouTube API that may affect your Recaps.
- The deletion or unavailability of video content on YouTube.
- The temporary or permanent loss of data stored on third-party servers.
- Any failures or inaccuracies in the automated moderation provided by third-party AI systems.
6.3 Limitation of Liability
To the maximum extent permitted by applicable law, Recap.Tube and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of:
- Your access to or use of (or inability to access or use) the service.
- Any conduct or content of any third party on the service.
- Any content obtained from the service.
- Unauthorised access, use, or alteration of your transmissions or content.
6.4 Indemnification
You agree to indemnify and hold harmless Recap.Tube and its operators from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your violation of these Terms or your misuse of the service.
6.5 Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Estonia. You agree that any disputes arising out of or in connection with these Terms or the use of Recap.Tube shall be subject to the exclusive jurisdiction of the courts of Estonia.
